Criminal cases for evading mobilization in 2023 – more than 2,000,000
During 2023, one of the “most common” criminal offenses was evasion of conscription for military service during mobilization, for a special period, which is provided for in Art. 336 of the Criminal Code of Ukraine. Every year, the number of such crimes is increasing, this is evidenced, among other things, by the statistics of courts regarding the consideration of criminal proceedings.
According to statistics published on the website of the Judiciary of Ukraine, in 2023, 2,021 proceedings were pending in courts of first instance, of which 1,847 were received in the reporting year.
A total of 1,321 proceedings were considered for the specified year. In 1257 proceedings, a verdict was passed, of which 390 were with the approval of a plea agreement.
In 2 criminal proceedings, the approval of the agreement was refused and returned to the prosecutor for the continuation of the pre-trial investigation, 2 proceedings were returned to the prosecutor, 57 proceedings were closed, and 3 were sent for determination of jurisdiction.
In total, in 2023, the number of persons convicted for evading the draft for military service during mobilization, for a special period, is 1,242, acquitted – 6. The criminal proceedings were closed for 56 persons, the approval of the agreement was refused for 2 persons and returned to the prosecutor for the continuation of the pre-trial investigation , regarding 2 – returned to the prosecutor, and regarding 3 – sent for determination of jurisdiction.
At the end of 2023, 700 pending criminal proceedings against 704 persons remained in the courts.
